STAY TERMS
These Terms apply between Michał R. Młodzianowski ("Owner") and the guest who makes the booking ("Renter") for The Vinci Residence, Kraków Old Town ("Property"). The dates, price and number of guests for each stay are set out in the individual booking confirmation.
The stay begins and ends on the dates set out in the booking. Check-in is available from 3:00 PM on the arrival date. The Property must be vacated no later than 10:00 AM on the departure date. Any change to the dates requires the Owner's written confirmation and payment of any additional fees.
The total price set out in the booking is payable in full at the time of booking.
The Renter must complete identity verification (a valid government-issued ID and a selfie) and accept these Terms via the Guest Portal. Access details are released only after both steps are completed. If verification is not completed within 48 hours of booking, or before check-in for bookings made less than 48 hours in advance, the Owner may cancel the reservation and refund the Renter in full.
Occupancy is limited to the number of guests specified in the booking. Overnight visitors and persons not listed in the booking are not permitted.
The Property is located in a residential building. Parties, events and gatherings of any kind are strictly prohibited. Quiet hours apply between 10:00 pm and 6:00 am. The Renter and all guests must respect the neighbours and the building's rules.
Smoking (including e-cigarettes) is prohibited inside the Property and on the patio. Pets are not allowed. A breach will result in a special cleaning fee of PLN 500.
The Renter shall use the Property with due care and is liable for any damage to the Property, furnishings or equipment caused by the Renter or their guests, beyond normal wear and tear. Damage must be reported to the Owner immediately. The Renter agrees to lock doors and windows when leaving the Property.
Access codes and keys are for the Renter's personal use only and must not be shared with third parties. Lost keys or access cards will be charged at PLN 800.
The Owner may request a refundable security deposit, depending on the nature of the reservation (including the size of the group, the length of stay and the stated purpose of stay). The deposit is released after check-out if no damage or breach of these Terms is found.
If the Renter materially breaches these Terms (in particular clauses 4, 5 or 6), the Owner may terminate the stay and require the Renter and all guests to vacate the Property immediately. In such case, payment for the remaining nights is non-refundable, and the Owner may claim compensation for documented damages and costs.
The Owner may enter the Property during the stay only in case of emergency, necessary repairs, or with prior notice to the Renter.
The Property is rented with its current furnishings and equipment. The Renter shall report any malfunction to the Owner without delay. The Owner will make reasonable efforts to repair or replace faulty equipment as soon as possible.
The Renter is responsible for the conduct of all guests and for any damage or third-party claims arising from their stay, to the extent permitted by applicable law. The Owner is not liable for the loss of personal belongings left in the Property, except where caused by the Owner's fault.
The Renter may not sublet or assign any rights under these Terms, in whole or in part. The stay is temporary and for short-term accommodation purposes only. The Property will not become the permanent residence of the Renter or any guest.
Cancellations and refunds are governed by the Direct Booking Cancellation Policy published at thevinciresidence.com at the time of booking. The statutory right of withdrawal for distance contracts does not apply to accommodation services provided on specific dates.
Personal data is processed by the Owner to perform these Terms, verify the Renter's identity and fulfil legal guest-registration obligations, in accordance with the General Data Protection Regulation (GDPR). Data is stored only for the period required by law. The Renter has the right to access, correct and request deletion of their data, subject to legal obligations.
These Terms are governed by the laws of Poland. Any disputes shall be resolved by the competent court having jurisdiction under applicable law.
By accepting these Terms, the Renter confirms that they have read and accepted them, and that they are responsible for ensuring all guests comply with them.
